Drawing on the works of philosophers Charles Taylor and Joseph Heath, this paper argues that the critique of consumerism is too often separated into an emphasis on “ideas” or “practices.” Taylor’s critique is set against the backdrop of his interpretation of the ideas and values that are constitutive of Western selfhood. To engage in excessive consumption, on this view, is to betray the ideals underlying one’s cultural identity. Heath, by contrast, argues that critics of consumerism must avoid this kind (...) of ideas-based social criticism because it is not only unproductive, but also illiberal and elitist. The phenomenon of consumerism must be approached, rather, by way of an institutional critique that treats excessive consumption as a collective action problem arising within the context of the market economy. The paper argues that while Heath makes an invaluable contribution to the critique of consumerism, his misunderstanding of the importance of ideas is such that his critique ultimately lacks vigor and persuasiveness. Since Charles Beard first focused attention upon it in 1913, the Tenth Federalist Paper has been at the centre of the debate concerning the foundations of the American republic. Specifically, there have been three primary interpretations of this document. Each corresponds to one of the three major traditions of interpretation that have dominated the study of American political thought in the twentieth century. Each also points towards and has been evoked in the service of drastically different political philosophies.

We argue that glory, while seductive, should not be sought for its own sake. We employ some Greek ethics, personalism, and the superhero figures "The Fantastic Four".

The United States Supreme Court's decision in Bell Atlantic Corp. v. Twombly is creating quite a stir. Suddenly gone is the famous loosey-goosey rule of Conley v. Gibson that a complaint should not be dismissed for failure to state a claim unless it appears beyond doubt that the plaintiff can prove no set of facts in support of his claim which would entitle him to relief.Now a complaint must provide enough facts to state a claim to relief that is (...) plausible on its face. Only decided last May, Bell Atlantic has been cited in over 3,700 cases. Already being described as a landmark decision, Bell Atlantic nonetheless has lawyers and judges scratching their heads over the precise pleading standard to apply in its wake. As the Second Circuit (mildly) put it, Considerable uncertainty concerning the standard for assessing the adequacy of pleadings has recently been created by the Supreme Court's decision in Bell Atlantic Corp. v. Twombly. Just what is a plausible showing that the pleader is entitled to relief under Rule 8(a)(2)?I believe an answer lies in the 26-year-old decision of the Former Fifth Circuit in In re Plywood Antitrust Litigation. Plywood Antitrust requires, at a minimum, that a complaint . . . contain either direct or inferential allegations respecting all the material elements necessary to sustain a recovery under some viable legal theory. Already used in more than half the circuits, this standard paraphrases advice found in the venerable WRIGHT & MILLER for nearly 40 years.Properly applied, this all . . . material elements standard satisfies Bell Atlantic's plausibility requirement in all respects. The Plywood Antitrust pleading standard works well after Bell Atlantic, first, because the Supreme Court referred to the standard, albeit parenthetically, with approval in Bell Atlantic. Second, it does much to harmonize the Federal Rules' goal of dispensing with pleading technicalities while still requiring enough general factual information about a pleader's claim to make the notice in notice pleading meaningful. Finally, and perhaps most importantly, it gives lawyers, litigants, and courts a standard they can actually use when drafting, or assessing the sufficiency of, pleadings. (shrink)

Systems for color naming across languages have been a fascinating topic for decades. Zaslavsky and colleagues challenge Gibson's argument that color names are shaped by patterns of communicative need. Using an information‐theoretic analysis, they show that color naming is shaped by both perceptual structure (as is usually argued) but also by communication need.

Following on from ecological theories of perception, such as the one proposed by [Gibson, J. J. . The senses considered as perceptual systems. Boston: Houghton Mifflin] this paper reviews the literature on the multisensory interactions underlying the perception of flavor in order to determine the extent to which it is really appropriate to consider flavor perception as a distinct perceptual system. We propose that the multisensory perception of flavor may be indicative of the fact that the taxonomy currently used (...) to define our senses is simply not appropriate. According to the view outlined here, the act of eating allows the different qualities of foodstuffs to be combined into unified percepts; and flavor can be used as a term to describe the combination of tastes, smells, trigeminal, and tactile sensations as well as the visual and auditory cues, that we perceive when tasting food. Anthony van Dyck’s period of service to the Stuart court stretches from 1632, when he was appointed “principalle Paynter in ordinary to their Majesties” and knighted, to his death at the end of 1641. After an earlier visit of a few months, beginning in December 160, van Dyck had gone to Italy to improve himself; there he had defected from the service of James I. On his return to England this was forgiven, and in the early years he was mainly (...) employed in making portraits of the royal family and household. Later he was again absent from England, spending an entire year beginning in July 1634 back in Antwerp. During the last six years van Dyck spent in England, his clientele widened further; it is chiefly the portraits of this latter period that I will consider here.These portraits have been approached and evaluated in two basic ways. First of all, they have been taken to demonstrate the adaptation of van Dyck’s preexisting skills, especially his command of the “grand style,” to the requirements of a court and aristocracy which prized grace and elegance as hallmarks of breeding and quality, and which at the same time welcomed the trappings of grandeur and the subtleties of variation, in costume, post, and gesture, that the artist could build into his presentation for their predilection.1 Second, where critical considerations have come up, these paintings have been evaluated in terms of whether the adoption of mannered and decorative traits now betokens a decline from the artist’s previous work, or whether it represents rather a different kind of achievement which gave rise, at its best, to equally outstanding successes in conveying refined and subtly enhanced distinction.2But both these approaches agree in finding no intellectual content in the works in question, either of van Dyck’s own devising or based on interests and concerns in which his subjects partook. This absence of implication to the portraits is seem as fitting with thea rtist’s tendency to make creative decisions on an ad hoc basis, as evidenced by his preference for rapidly made drawings from the life over the use of oil sketches and by the pentimenti that his finished works reveal.3 It is also seen as fitting with the whole pattern—cultural as well as social and economic—of his relationship to the Stuart aristocrazy, for which these images were fashioned. 1. In leading one’s own life, faith contains more than having certain beliefs, and reason grasps more than having scientific methods. Taylor answers questions regarding the relation of his great narrative to the approaches of M. Heidegger, M. Merleau-Ponty, M. Foucault, K. Jaspers, and S. Eisenstadt (axial cultures and multiple modernities). Insofar as the secularization of Christianity involves ironic reversals, all main directions in (...) Western modernity (forms of religion, secular humanism, and anti-humanism) are faced with dilemmas. Instead of looking for scapegoats in the others, all directions are called upon to cooperate. Title: Martin Heidegger's Critique of Freedom Author: Charles Robinson Advisor: Professor Susan Shell Boston College Political Science Department This is a study of thought and politics of Martin Heidegger. It presents an examination of his understanding of freedom, principally as he expressed it in Being and Time, but also considers some of his subsequent essays and lectures, as well as his Rectorate Address. Ever since Heidegger's public embrace of National Socialism, his defenders and critics have argued about the possible (...) relation between his thinking and his infamous political commitments. While many of his critics have linked his commitments to an alleged lack of understanding of freedom, some of his scholarly defenders have sought to present interpretations of his concept of freedom at odds with his infamous politics, in order to separate his thought from any association with Nazism. The conclusions of these critics and defenders of Heidegger are both mistaken: in Being and Time Heidegger sought the meaning of being in the authentic experience of human self-determination revealed by the conscience, which he worked out as "forward running resolve." It was this militant concept of freedom that grounded his project for a destined community of battle to be championed by a free corps of freedom fighters, and led him to embrace, in the very name of freedom, the tyranny of Hitler's new Reich. The study of Heidegger's concept of authentic freedom reveals that, far from lacking any understanding of freedom, it was rather a central theme and concern of his philosophical efforts, and that his infamous political commitments were indeed its necessary and coherent practical consequence. Heidegger's thought thus poses a more trenchant and pressing challenge to liberal (and leftist) politics than many of his critics and defenders appreciate. There have been comparatively few sustained thematic treatments of Heidegger's understanding of freedom in English. This study accordingly hopes to contribute to an understanding of this central theme of Heidegger's philosophical efforts, which not only reveals their necessary connection to his politics, but also promises to improve our access to the coherent intelligibility of his thought as a whole. ABSTRACT In this article we call for a paradigm change in relation to the way we tend to look at how markets and morals are entwined in the writings of Jonathan Swift (1667–1745). We argue that it would be wrong to apply contemporary notions of economics retrospectively and somewhat a-historically to a thinker of an axial time in which economics as a separate sphere did not exist, and morals and markets and the way they relate to each other were about (...) to be reconceptualised. We argue that it is thus no accident that Scottish Enlightenment thinkers such as David Hume and Adam Smith took to Swift. They admired more than the expressive or rhetorical skills in Swift; in the first instance, they read Swift as somebody who managed to express moral sentiments (and even outrage) in an appealing, that is mostly satirical way, thereby not only criticizing the cruel conditions in Ireland at the time but also identifying the gap between rhetoric and reality and thus taking issue with the hypocrisy and double standards of the time. We will use two famous examples of Swift's work to illustrate our case, A Modest Proposal (1729) and Directions to Servants (1745). (shrink)
